The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Account means a unique account created for you to access our Service or parts of our Service.
Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to RAW Artists as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.
Company refers to RAW Artists, Inc., 161 W Altadena Dr, Suite 7808, Altadena CA 91001 (referred to as either "RAW Artists", "we", "us" or "our" in this Agreement).
Consumer, for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
Cookies are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.
Country refers to: California, United States
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
Non-Personal Data means any information that does not relate to a person and/or cannot be used to identify a person.
Personal Data is any information that relates to an identified or identifiable individual.
For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.
Service refers to products, features and offerings available through the Website.
Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
Showcase Producer means users who create or organize showcases for Consumers using our Services.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
Website refers to My Site, accessible from www.rawartists.com
You, Your, Users means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable including Showcase Producers, Consumers and third-parties using our Services.
When you use or interact with us through the Services, we may collect Personal Data. Sometimes this will be on our own behalf and other times this will be on behalf of a Showcase Producer using our Services to run an showcase. This is an important distinction for purposes of certain data protection laws and is explained in more detail below.
If you are a Showcase Producer, we will collect additional Personal Data from you.
If you are a Consumer we will collect additional Personal Data from you, sometimes for our own purposes and other times on behalf of a Showcase Producer.
If you provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem and will respond to the email address from which the contact came.
If you provide Personal Data to obtain access to or use of the Services or any functionality thereof, we will use your Personal Data to provide you with access to or use of the Services or functionality and to analyze your use of such Services or functionality. For instance, if you supply Personal Data relating to your identity or qualifications to use certain portions of the Services, we will use that information to decide whether to grant you access to use such Services and to assess your ongoing qualification to use such Services.
We may use your Personal Data for internal business purposes, including without limitation, to help us improve the content and functionality of the Services, to better understand our Users, to improve the Services, to protect against, identify or address wrongdoing, to enforce our Terms of Service, to manage your account and provide you with customer service, and to generally manage the Services and our business.
We may use your Personal Data for our marketing and advertising purposes, including (without limitation) by email, SMS marketing, display media, and targeting other Devices. We do this to inform you about Services or showcases we believe might be of interest to you, develop promotional or marketing materials and display RAW Artists or showcase-related content and advertising on or off the Services that we believe might be of interest to you. We may also do this on behalf of a Showcase Producer, for example where your prior interactions with a Showcase Producer suggest you may be interested in a particular type of showcase. See "Opt Out from Electronic Communications" below on how to opt out of our various marketing communications.
You may see advertisements for our Services on third party websites, including on social media platforms. We may provide Showcase Producers with tools to help them display advertisements for their showcases on third-party websites and social media platforms. Where you see an advertisement on a third-party website or social media platform, this may be because we or the Showcase Producer engaged the third party or social media platform to show the advertisement to Users, or to others who have similar attributes to our Users. In some cases, this involves sharing your email address or other contact details with the third party or social media platform so that they can identify you as one of our Users, or identify other individuals with similar attributes to you in order to show them advertisements for our Services (or for our Showcase Producer’s showcases). If you no longer want your Personal Data to be used for these purposes please contact us at [email protected]. In the case of an Showcase Producer’s advertising, you may need to contact the Showcase Producer directly. For more information about how we and Showcase Producers market on, and interact with social media sites, please refer to section 5.6.
We allow Showcase Producers to use our email tools to contact Consumers for their current and past showcases, so you may receive emails from our system that originate with such Showcase Producers and that we send on their behalf. If you registered for a showcase on the Services, your email address is available to that Showcase Producer. However, Showcase Producers may also import the email addresses they have from external sources and send communications through the Services to those email addresses, and we will deliver those communications to those email addresses on the Showcase Producer's behalf. The Showcase Producer and not RAW Artists is responsible for sending these emails. See "Opt Out from Electronic Communications" below on how to opt out of Showcase Producer-initiated communications.
We sometimes make inferences about the type of showcases or activities you may be interested in. We may use these inferences to help target advertising or customize recommendations to you, including on behalf of Showcase Producers. We may do this on an aggregated or generalized basis.
Your information, including Personal Data, is processed at our operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to – and maintained on - computers located outside your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
We may share your Personal Data with our contractors and service providers who process Personal Data on behalf of RAW Artists to perform certain business-related functions. These companies include our marketing agencies, online advertising providers, data enhancement and data services providers, database service providers, backup and disaster recovery service providers, email service providers, payment processing partners, customer support, tech support, hosting companies and others. When we engage another company to perform such functions, we may provide them with information, including Personal Data, in connection with their performance of such functions.
When you purchase tickets to, register for or donate to an showcase, transfer an showcase ticket or registration to another person, enter a contest, or otherwise input your Personal Data (such as through a web form), or otherwise communicate with an Showcase Producer, or participate in or express interest in an Showcase Producer or Showcase Producer showcase or activity, that Showcase Producer will receive the information you provide, including your Personal Data, and where a ticket or registration is transferred, the Personal Data of the transferee as well. Other third parties that are involved in or on whose behalf a showcase or activity is promoted, may receive that Personal Data as well. For example, as to fundraising pages, we may provide your Personal Data both to the charity of the fundraising page and the Showcase Producer of the showcase to which the fundraising page is linked. In some instances, a Showcase Producer may appoint a third party, which may or may not be affiliated with the Showcase Producer, to create a showcase or fundraising page on its behalf (we call these third parties ("Third Party Organizers").
For example, and without limitation, a concert venue (the Showcase Producer, in this case) may allow third party promoters or production companies (the Third Party Organizers) to create showcases that will be hosted at the Showcase Producer's venue using its RAW Artists account. In that case, we may provide your Personal Data to the Third Party Organizers on behalf of the Showcase Producers. The same is true for contests and sweepstakes: we may provide your Personal Data to both the Showcase Producer promoting the contest or sweepstakes, and any legal sponsor of the contest or sweepstakes (such as a brand sponsor).
We are not responsible for the actions of these Showcase Producers, or their Third Party Organizers (or other downstream recipients of your Personal Data), with respect to your Personal Data. It is important that you review the applicable policies of the Showcase Producers, and if applicable and available, their appointed Third Party Organizers, of an showcase (and the related fundraising page, if applicable) before providing Personal Data or other information in connection with that showcase or related fundraising page. Similarly, if you are a member of a Showcase Producer's organization within RAW Artists, your Personal Data will be available to the Showcase Producer and shared with those Third Party Organizers granted permission by the Showcase Producer to view all members of the Showcase Producer's organization.
We may disclose your Personal Data if required to do so by law in order to (for example) respond to a subpoena or request from law enforcement, a court or a government agency (including in response to public authorities to meet national security or law enforcement requirements), or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect or defend our rights, interests or property or that of third parties, (c) prevent or investigate possible wrongdoing in connection with the Services, (d) act in urgent circumstances to protect the personal safety of Users of the Services or the public, or (e) protect against legal liability.
You can access, correct or delete your Personal Data stored by us by contacting us. You can ask us to correct and update any inaccurate Personal Data using the contact information below, and we will consider your request in accordance with applicable laws.
If a Consumer initiates a data deletion request, RAW Artists is authorized to delete or anonymize Personal Data of the requesting Consumer from the Services even if that means removing its availability to the Showcase Producer through the Services. However, if you are a Consumer, you understand that even if RAW Artists deletes or anonymizes your Personal Data upon your request or pursuant to this Policy, your Personal Data may still be available in the Showcase Producer's own databases if transmitted to the Showcase Producer prior to RAW Artists receiving or taking action on any deletion or anonymization activity.
Unregistered Users may also access, update, correct or delete Personal Data and exercise these rights using the contact information below. We will consider and respond to all requests in accordance with applicable law.
We may retain your Personal Data as long as you are registered to use the Services. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.
We will also retain Automatic Data for internal analysis purposes. Automatic Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service or we are legally obligated to retain this data for longer time periods.
The Service Providers we use may have access to your Personal Data. These third-party vendors collect, store, use, process and transfer information about your activity on our Service in accordance with their privacy policies.
We may use third-party Service Providers to monitor and analyze the use of our Service.
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.
We may use email marketing Service Providers to manage and send emails to You.
We provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g. payment processors).
These third-party vendors collect, store, use, process and transfer information about your activity on Our Service in accordance with their privacy policies and to enable us to:

We may use third-party Service Providers to provide better improvement of our Service.
We use an invisible captcha service named reCAPTCHA. reCAPTCHA is operated by Google.
The reCAPTCHA service may collect information from You and from Your Device for security purposes.
You have several choices available when it comes to your Personal Data:
You can browse the Services without providing any Personal Data (other than Automatic Data to the extent it is considered Personal Data under applicable laws) or with limiting the Personal Data you provide. If you choose not to provide any Personal Data or limit the Personal Data you provide, you may not be able to use certain functionality of the Services. For instance, in order to buy tickets as a Consumer, your name and email address will be required by the Showcase Producer.
We currently do not participate in any "Do Not Track" frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your Personal Data.
If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent’s consent before we collect and use that information.
If you have a complaint about RAW Artists’ privacy practices you should contact us. We will take reasonable steps to work with you to attempt to resolve your complaint.
